Terms of Service

1. Acceptance of Terms

By accessing the Site, submitting an application, or otherwise using the Service, you confirm that: (a) you are at least 18 years old; (b) you have read, understood, and agree to be bound by these Terms and our Privacy Policy; and (c) you have the legal capacity to enter into a binding agreement.

2. What we do

Start a Tester operates a referral and matching service that introduces interested individuals ("applicants" or "testers") to consumer product testing programs run by independent third-party brand partners. We do not manufacture, sell, ship, or warrant any products ourselves. We do not employ testers. We do not directly determine acceptance into any specific testing program — those decisions are made solely by the brand partner administering each program.

3. Eligibility

To use the Service, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction, if higher);
• Be a legal resident of the United States or another jurisdiction in which the Service is offered;
• Provide accurate, truthful, and complete information when you apply;
• Maintain only one active tester record at a time (duplicate applications are prohibited);
• Comply with these Terms, our Privacy Policy, and any additional terms imposed by partner platforms when you are matched.

4. Conduct & obligations

By using the Service, you agree to:

• Provide truthful, accurate, and current information in your application and any subsequent submissions;
• Use the Service only for lawful purposes and in accordance with these Terms;
• Refrain from misrepresenting your identity, age, location, or product usage;
• Refrain from creating duplicate, fraudulent, or automated applications;
• Provide genuine, unbiased, and original written feedback for any product you receive through a partner program;
• Comply with the specific guidelines, deadlines, and requirements communicated for each partner program;
• Not use the Service to engage in any activity that violates applicable law or infringes the rights of others.

We reserve the right to suspend or permanently remove testers who violate these obligations or engage in fraudulent, abusive, or deceptive activity, without prior notice.

5. Intellectual property

All content on the Site — including text, graphics, logos, layout, code, and the "Start a Tester" name and brand — is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, scrape, or create derivative works from any part of the Site without prior written permission, except for personal, non-commercial viewing of the Site itself.

Any feedback, ideas, or suggestions you submit to us about the Service may be used by us freely without any obligation, compensation, or attribution to you.

6. Third-party services and links

The Service may include links to or integrations with third-party websites, partner platforms, advertising networks, and analytics providers. We do not control these third parties and are not responsible for their content, terms, privacy practices, or operations. Your interactions with any third party are governed solely by that third party's own terms and policies.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

WE MAKE NO REPRESENTATION OR WARRANTY THAT APPLYING WILL RESULT IN YOUR SELECTION FOR ANY PRODUCT TESTING PROGRAM OR THAT YOU WILL RECEIVE ANY PRODUCT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, START A TESTER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED USD $50.

9. Indemnity

You agree to defend, indemnify, and hold harmless Start a Tester and its officers, directors, employees, contractors, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any feedback, review, or content you submit through the Service.

10. Dispute resolution

10.1 Informal resolution first

Before filing any formal claim, you agree to first contact us at support@startastester.com and make a good-faith effort to resolve the dispute for at least 30 days before proceeding to formal dispute resolution.

10.2 Governing law and venue

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Subject to Section 10.3, exclusive jurisdiction and venue for any dispute not subject to arbitration lie in the state and federal courts located in New Castle County, Delaware.

10.3 Binding arbitration; class action waiver

EXCEPT FOR CLAIMS FOR INJUNCTIVE OR EQUITABLE RELIEF REGARDING INTELLECTUAL PROPERTY, OR WHERE PROHIBITED BY LAW, ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED BY FINAL, BINDING, INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) UNDER ITS CONSUMER ARBITRATION RULES. YOU AND START A TESTER EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING OF ANY KIND.

You may opt out of this arbitration agreement by sending written notice to support@startastester.com within 30 days of first accepting these Terms. The subject line should read: "Arbitration Opt-Out."

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to breach of these Terms, suspected fraud, or compliance with a legal requirement. You may terminate your participation at any time by contacting us as described in Section 4.

The following sections will survive termination: Disclaimers (Section 7), Limitation of Liability (Section 8), Indemnity (Section 9), Dispute Resolution (Section 10), and General (Section 14).

12. Communications

By submitting your email address through the Service, you consent to receive transactional and program-related communications from us. We comply with the CAN-SPAM Act and other applicable electronic communications laws. You may unsubscribe from marketing emails at any time using the unsubscribe link in any email we send, or by contacting support@startastester.com. We do not sell or rent your contact information to third-party marketers.

13. Independence & non-affiliation

Start a Tester is an independent company. We are not affiliated with, endorsed by, authorized by, or sponsored by Amazon.com Inc., Meta Platforms Inc., Facebook, Instagram, or any other retailer, social media platform, government agency, or well-known third-party brand. The name "Start a Tester" refers solely to the independent operator of startastester.com.

References to third-party brand names or product categories anywhere on the Site are used for illustrative and identification purposes only and remain the intellectual property of their respective owners.

14. General provisions

14.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Start a Tester with respect to the Service and supersede all prior agreements, representations, and understandings.

14.2 Severability

If any provision of these Terms is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall continue in full force and effect.

14.3 No waiver

Our failure to enforce any right or provision of these Terms on any occasion shall not be deemed a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, or sale of assets.

14.5 Modifications

We may revise these Terms from time to time. The "Effective" date at the top reflects the latest revision. Your continued use of the Service after the effective date constitutes your acceptance of those changes.

14.6 Force majeure

We shall not be liable for any delay or failure to perform our obligations where such delay results from causes beyond our reasonable control, including acts of God, natural disasters, war, or government action.
